User Agreement

Introduction

This agreement sets out the terms and conditions of your use of the New Curiosity Shop and facilities provided by the New Curiosity Shop. Please read them carefully before accessing the website as a visitor, subscriber, reader, writer or client.

Eligibility

As a subscriber or user of the New Curiosity Shop you confirm that you are 16 years or over.

Online conduct

By accessing the New Curiosity Shop website you agree to be legally bound by these terms and conditions, which take effect immediately on your first use of the New Curiosity Shop. If you do not agree to be legally bound by all the following terms and conditions then please do not access or use the New Curiosity Shop.

  • In accessing the New Curiosity Shop website you specifically agree not to carry out any of the following acts:
  • use the website to commit illegal acts or encourage similar behaviour;
  • impersonate any employee of the New Curiosity Shop or any other person;
  • use the New Curiosity Shop website to distribute any computer virus or other such device;
  • tamper with the electronic communication of any other individual;
  • access any user accounts that are not your own;
  • use inappropriate user names (e.g. offensive or vulgar);
  • maliciously disrupt electronic discussions;
  • solicit other users; or,
  • post material that:
  • defames or threatens others;
  • is objectionable or hateful;
  • contains obscene language or images; or,
  • infringes the intellectual property rights of others.

Distance Selling and E Commerce Regulations

In addition to the Data Protection Act 1998, the New Curiosity Shop complies with the Consumer Protection (Distance Selling) Regulations 2000, the Electronic Commerce (EC Directive) Regulations 2002 and the Privacy and Electronic Communications Regulations 2003. For further information on our responsibilities under the Data protection Act see our Data Protection statement.

Briefly, the Consumer Protection (Distance Selling) Regulations 2000 sets out the following key points. The business should:

  • provide clear information about any product before purchase;
  • provide a written confirmation following purchase; and,
  • provide a “cooling off” period of 7 working days.

The New Curiosity Shop seeks to comply with the above regulations by:

    • providing a clear and concise course summary, including start date(s), length and study time required for all courses delivered at the New Curiosity Shop;
    • providing details of any pre-requisites, hardware and/or software requirements, books or other materials;
    • provide a clear statement of the all-in cost of the course (in pounds sterling or euros); and,

The New Curiosity Shop seeks to comply with the above regulations by:

      • providing a clear and concise course summary, including start date(s), length and study time required for all courses delivered at the New Curiosity Shop;
      • providing details of any pre-requisites, hardware and/or software requirements, books or other materials;
      • provide a clear statement of the all-in cost of the course (in pounds sterling or euros); and,
      • sending an email confirming enrolment and giving details of the “cooling off” period and conditions of withdrawal on receipt of the course fee.

The Electronic Commerce (EC Directive) Regulations 2002, also known as the Ecommerce Directive, lists the following key points. The business should:

      • display its name;
      • display the proprietor’s name;
      • display the geographic address of the business;
      • provide contact information (e.g. e-mail and telephone number(s));
      • provide the VAT number, if registered;
      • provide clear information on the price, tax and delivery charges;
      • show clear Terms and conditions; and,
      • acknowledge orders.

In addition to the previous list the New Curiosity Shop seeks to comply with these regulations by:

      • providing details of the business through a link on our home page; and,
      • providing a Terms and Conditions statement.

The Privacy and Electronic Communications Regulations 2003 insofar as they relate to the internet governs marketing by e-mail and the use of cookies. In particular they provide for:

      • an “opt-in” facility whereby individuals have to give their explicit
        prior consent to receiving direct marketing e-mail;
      • an “opt-out” facility. If a customer’s details are obtained in the course of a sale of a product or service, these details may be used to market your own same or similar products or services to that customer. However, the customer must be given, clearly and distinctly, the opportunity to opt-out easily and free of charge when the details are collected and on any subsequent marketing e-mail; and,
      • a new transparency requirement for cookies and similar tracking devices – anyone that employs these kinds of device must provide information on them and allow subscribers or users to refuse to accept them if they wish.

The New Curiosity Shop seeks to comply with these regulations by:

      • only sending e-mails to you if you subscribe to the New Curiosity Shop, are a student, tutor or client of the New Curiosity Shop;
      • providing a clear means of unsubscribing to our mailing list both on our website and whenever information or marketing emails are sent to you; and,
      • specifying when cookies are used – see the section on Cookies in our Privacy
        Policy.

Expert opinion

Material found on the New Curiosity Shop website and course material may express the views and opinions of employees of the New Curiosity Shop or other users and are not necessarily complete or accurate. These are their views and opinions and do not necessarily represent the views and opinions of the New Curiosity Shop and we are not liable for any claims resulting from these opinions.

Personal accounts

As a subscriber, student, tutor or client of the New Curiosity Shop you are responsible for keeping your personal account information secure and confidential. In particular you undertake not to disclose such information (e.g. account, login and password details) to any third party. Any unauthorised use of your account should be brought immediately to the attention of the New Curiosity Shop by sending an email to accounts.

Copyright

The New Curiosity Shop website is the copyright of the New Curiosity Shop unless otherwise stated. Course material is the copyright of the author (tutor). It is your sole responsibility to comply with copyright laws. The New Curiosity Shop grants you the right to download or copy content from the website exclusively for your personal, non-commercial use. Any other reproduction, copying or distribution of any copyrighted elements of the website is strictly prohibited.

Trademarks

The New Curiosity Shop is registered with the Trademarks Registry (No. 2200438). Details can be found via the Patent Office website. Any third party graphics or logos found on the New Curiosity Shop website are the trademarks of those parties, and you agree not to reproduce or otherwise misuse such logos without their respective prior written consent.

Disclaimer

The content of the New Curiosity Shop website is provided “AS IS” and on an “IS AVAILABLE” basis. Whilst we endeavour to keep this material up to date
and accurate, the New Curiosity Shop makes no representations or warranties of
any kind, express or implied, about the completeness, reliability, accuracy or
suitability with respect to the website information, services or related items
contained on the website for any purpose.

The New Curiosity Shop will not be liable for any damages, including indirect
or consequential damages, or any damages arising from use or loss of use, of
profits or data, whether in contract, negligence or other tortious action, arising
from or in connection with the New Curiosity Shop.

Availability and delivery of courses

Although every effort is made to ensure that New Curiosity Shop courses are delivered as scheduled there may be times when, due to circumstance beyond our control, this is not possible. In such cases a fully enrolled student (i.e. a student who has paid in full for the course which has become unavailable) will be given an option of a) being transferred to a later delivery of the course, b) being enrolled, at no extra cost, on a similar course mutually agreed by the student and New Curiosity Shop, or c) having their enrolment fee refunded in full.

Complaints procedure

We hope that you will be very pleased with our services, whether as students, tutors or clients and that you will want to recommend us to others. However if you feel you have any cause for complaint please let us know in writing: our details are available on our Contact Us page. We will acknowledge your communication, investigate your complaint and get back in touch with you as soon as we can.

Withdrawal / cancellation rights

As a student enrolling on a course at the New Curiosity Shop you have the right to withdraw from a course within seven working days of the commencement of the course, irrespective of when the initial enrolment and payment were made. Within these limits the New Curiosity Shop will undertake to refund the course fee in full. If, after following a course for up to and including 20% of the allotted time, you wish to withdraw the New Curiosity Shop will also undertake to refund the course fee in full. Any other request for refunds will be considered on an individual basis.

Applicable law

The New Curiosity Shop operates under the applicable laws of Scotland and the
UK

Legally binding contract when enrolling on a course

When enrolling on a course at the New Curiosity Shop you and we enter into a
legally binding contract as set out in this User Agreement.

Changes to this Agreement

This agreement will be reviewed from time-to-time and any changes will be posted here. You should check this agreement at regular intervals to ensure that you are aware of any changes, additions or deletions.
